Welcome to MixedApe. By using the website or app at mixedape.app (the "Service"), you agree to these Terms of Service. If you don't agree, don't use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use MixedApe. You're responsible for the accuracy of the information you provide and for keeping your account secure. You may not share your account or use someone else's.
MixedApe lets you identify songs, save them to playlists organized by people in your life, attach memories to songs, and share curated mixtapes. The Service depends on Spotify for music metadata, in-app previews, and (when you connect your Spotify account) playback features.
We may change, add, or remove features at any time. We may impose usage limits to ensure fair use of the Service.
The free tier of MixedApe includes limited capacity for people, daily song identifications, monthly mixtapes, and song memories. Specific current limits are visible in your in-app settings.
MixedApe Premium is a recurring subscription that unlocks unlimited use of MixedApe's features (people, song identifications, mixtapes, and memories) and includes early access to new MixedApe features. Premium does not provide any additional Spotify access or Spotify content. Spotify functionality remains the same regardless of plan.
All subscription payments are non-refundable except where required by law. If you believe you were charged in error, contact us within 14 days and we will review the request in good faith.
MixedApe lets you order physical keepsakes — CDs, cassettes, and vinyl records — printed with your mixtape's cover art, tracklist, and a QR code that plays the mixtape. Payment for gift orders is processed by Stripe and shipping is collected at checkout.
If your order arrives damaged, is lost in transit, or is incorrect (wrong format, missing items, etc.), contact us within 30 days of the ship date with photos (where applicable) and your order number. We will, at our discretion, either reship the order at no cost to you or issue a refund of the purchase price.
Because gift orders are printed-on-demand and personalized to your mixtape, we cannot accept cancellations once production begins. If you need to cancel, contact us as soon as possible after ordering — we'll cancel and refund if production has not yet started. Once a gift has shipped, refund eligibility is limited to the damaged/lost/incorrect cases described above.
Each gift order includes free MixedApe Premium months for the sender (and, where applicable, the recipient when they save the mixtape to their account). Bonus months are non-refundable and non-transferable; if a gift order is refunded, any bonus months credited from that order may be revoked.
MixedApe is a third-party application that uses the Spotify Web API and Spotify embed player. By connecting your Spotify account, you also agree to Spotify's Terms of Use. Spotify content is provided by Spotify, not MixedApe; we do not download, cache, or redistribute Spotify audio. Premium MixedApe features do not affect or replace your Spotify subscription status.

We may suspend or terminate your account if we reasonably believe you've violated these Terms.
You retain ownership of content you create in MixedApe (the people you add, memories you write, mixtapes you assemble). By creating content in the Service, you grant us a worldwide, non-exclusive license to store and display it solely as needed to operate the Service for you and the recipients you share with.
MixedApe's name, logo, design, and code are owned by MixedApe and protected by intellectual property laws. You may not copy or reuse them without permission. Spotify's trademarks and content remain Spotify's property.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, secure, or error-free, that song identification will always be accurate, or that Spotify integration will always function (Spotify may change their API at any time).
To the maximum extent permitted by law, MixedApe and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You can stop using MixedApe and delete your account at any time. We can terminate or suspend your access if you violate these Terms. On termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, dispute resolution) will survive.
Any dispute arising out of these Terms or your use of the Service will be resolved by binding arbitration administered by a recognized arbitration provider in the United States, on an individual (not class) basis. You and MixedApe waive any right to a jury trial or class action. This section does not prevent either party from seeking injunctive relief in court for intellectual-property infringement.
These Terms are governed by the laws of the United States and the State in which MixedApe is operated, without regard to conflict-of-laws principles.
We may revise these Terms from time to time. The "Last updated" date at the top will reflect any changes. Material changes will be communicated through the app or by email. Continued use of the Service after changes take effect constitutes acceptance.
